The Platform is intended to support users in understanding their performance, lifestyle, wellbeing, recovery, and progress.
4. HOLORA’S ROLE
Holora operates solely as a technology platform and digital infrastructure provider.
Holora is not:
- A hospital
- A healthcare provider
- A physician
- A medical practice
- A rehabilitation clinic
- A psychological service
- A therapy provider
- An emergency response service
- A nutrition clinic
- A licensed healthcare institution
Holora does not provide:
- Medical advice
- Medical diagnosis
- Medical treatment
- Emergency services
- Healthcare services
- Clinical monitoring
- Professional healthcare supervision
Any content, guidance, recommendations, analytics, scores, insights, educational materials, or suggestions provided through Holora are intended solely for informational, educational, motivational, lifestyle, fitness, wellbeing, and general guidance purposes.
Users remain solely responsible for all decisions affecting their health, safety, wellbeing, finances, and personal circumstances.
5. ELIGIBILITY REQUIREMENTS
To use Holora, you must:
- Be at least eighteen (18) years of age.
- Possess legal capacity to enter into binding agreements.
- Not be prohibited from using the Platform under applicable laws.
- Not have been previously removed or banned by Holora.

Nothing within the Platform shall be interpreted as creating legal representation or professional supervision by Holora.

Platform services are provided on an „as available“ basis.

2.7 Nutritionist
„Nutritionist“ means any individual providing nutrition-related content, guidance, educational materials, meal plans, nutritional recommendations, or related services through the Platform.
2.8 Creator
„Creator“ means any User who publishes, uploads, distributes, sells, licenses, streams, promotes, or otherwise provides content through the Platform.
2.9 Marketplace
„Marketplace“ means any section of the Platform enabling Users and Professionals to discover, communicate, book, purchase, sell, provide, or receive services, content, consultations, subscriptions, events, programs, products, or digital offerings.
2.10 Marketplace Services
„Marketplace Services“ means all products, services, consultations, coaching, plans, educational offerings, subscriptions, digital goods, events, communications, and transactions facilitated through the Marketplace.
2.11 Independent Provider
„Independent Provider“ means any Professional operating through the Platform who is not employed, supervised, directed, controlled, managed, or represented by Holora.
2.12 AI Systems
„AI Systems“ means all artificial intelligence models, machine learning systems, algorithms, automated tools, recommendation engines, predictive systems, analytics engines, language models, scoring systems, and automated technologies made available by Holora.
2.13 AI Output
„AI Output“ means any recommendation, analysis, summary, score, suggestion, report, prediction, insight, response, educational material, generated content, or automated communication produced by AI Systems.
2.14 User Content
„User Content“ means all information, text, images, videos, audio, comments, reviews, messages, data, biometric information, training records, nutrition records, recovery records, wearable information, files, communications, and materials uploaded, submitted, shared, transmitted, stored, or created by a User.
2.15 Professional Content
„Professional Content“ means all content, programs, plans, services, educational materials, recommendations, consultations, communications, videos, documents, courses, events, and materials provided by Professionals.
2.16 Holora Content
„Holora Content“ means all content owned, licensed, developed, created, operated, or distributed by Holora, including trademarks, logos, software, designs, systems, interfaces, databases, methodologies, frameworks, graphics, and proprietary materials.
2.17 Health Data
„Health Data“ means information relating to health, wellbeing, fitness, exercise, recovery, sleep, activity levels, body measurements, nutrition, hydration, performance metrics, readiness metrics, recovery metrics, lifestyle factors, and similar information voluntarily submitted or generated through Platform use.
2.18 Biometric Data
„Biometric Data“ means physiological, biological, behavioral, sensor-based, wearable-generated, or body-related measurements collected, processed, stored, or analyzed through the Platform.
2.19 Wearable Data
„Wearable Data“ means information obtained from wearable devices, fitness trackers, smart watches, rings, sensors, health integrations, or third-party monitoring technologies.
2.20 Connected Devices
„Connected Devices“ means hardware, wearables, sensors, mobile devices, tablets, smart watches, smart rings, trackers, and third-party technologies integrated with the Platform.
2.21 Subscription Services
„Subscription Services“ means recurring paid services offered through monthly, annual, promotional, enterprise, family, corporate, trainer, creator, or other subscription plans.
2.22 Digital Goods
„Digital Goods“ means downloadable content, digital programs, courses, plans, subscriptions, memberships, media, educational resources, AI services, and other digital products.
2.23 Coins
„Coins“, „Credits“, or similar virtual units mean digital rewards, credits, loyalty units, engagement units, promotional units, subscription benefits, marketplace credits, or virtual currencies used within the Platform.
Coins have no cash value unless expressly stated otherwise by Holora.
2.24 Enterprise Services
„Enterprise Services“ means business-to-business services, corporate wellness programs, gym partnerships, hotel integrations, API access, enterprise software, analytics services, consulting services, licensing arrangements, and commercial partnerships.
2.25 Event
„Event“ means any virtual, physical, hybrid, educational, training, networking, coaching, wellness, performance, or promotional activity offered through or connected with the Platform.
2.26 Third-Party Services
„Third-Party Services“ means services, products, platforms, applications, payment processors, wearable manufacturers, analytics providers, hosting providers, cloud providers, communication services, software providers, and external technologies not owned or controlled by Holora.
2.27 Payment Processor
„Payment Processor“ means Stripe or any authorized third-party provider responsible for processing payments, subscriptions, transactions, refunds, or financial services.
2.28 Intellectual Property
„Intellectual Property“ means all copyrights, trademarks, service marks, trade names, trade dress, patents, trade secrets, databases, software rights, design rights, domain names, know-how, methodologies, and proprietary rights recognized under applicable laws.
2.29 Applicable Laws
„Applicable Laws“ means all local, national, international, regulatory, statutory, administrative, and governmental laws, regulations, directives, orders, guidelines, and legal requirements applicable to Platform operations.
2.30 Force Majeure Event
„Force Majeure Event“ means events beyond reasonable control, including natural disasters, war, terrorism, cyberattacks, pandemics, governmental actions, internet disruptions, power outages, labor disputes, infrastructure failures, cloud outages, or similar circumstances.
2.31 Interpretation
Headings are included for convenience only and shall not affect interpretation.
References to singular include plural and vice versa.
References to any gender include all genders.
The words „including“, „includes“, and „include“ shall be interpreted as „including without limitation.“
PART 3 — MARKETPLACE, PROFESSIONAL SERVICES & INDEPENDENT PROVIDERS
3.1 Marketplace Function
Holora operates a technology-enabled marketplace that allows Users to discover, communicate with, engage, purchase from, learn from, subscribe to, or otherwise interact with independent Professionals.
The Marketplace may facilitate access to:
- Personal trainers
- Fitness coaches
- Nutritionists
- Recovery specialists
- Educators
- Content creators
- Mentors
- Consultants
- Wellness professionals
- Sports professionals
- Performance specialists
- Enterprise providers
- Other independent service providers
Holora solely provides the digital infrastructure that enables these interactions.
3.2 No Employment Relationship
All Professionals using the Platform are independent third parties.
Nothing contained within the Platform shall be interpreted as creating:
- Employment
- Partnership
- Agency
- Joint venture
- Franchise
- Representative relationship
- Fiduciary relationship
between Holora and any Professional.
Professionals are solely responsible for:
- Their qualifications
- Certifications
- Licenses
- Registrations
- Insurance
- Professional conduct
- Advice
- Recommendations
- Programs
- Services
- Communications
- Business practices
3.3 No Professional Endorsement
Holora does not endorse, certify, verify, guarantee, warrant, or represent:
- Professional qualifications
- Professional competence
- Professional experience
- Certifications
- Licenses
- Educational background
- Results
- Recommendations
- Opinions
- Statements
- Advice
- Content
- Services
Any profile information displayed by a Professional originates from that Professional and may not be independently verified by Holora.
Users assume full responsibility for evaluating Professionals before engaging their services.
3.4 No Guarantee of Results
Holora makes no representation, warranty, or guarantee regarding:
- Weight loss
- Muscle gain
- Fitness improvements
- Performance improvements
- Recovery outcomes
- Longevity outcomes
- Nutritional outcomes
- Wellness outcomes
- Medical outcomes
- Business outcomes
- Educational outcomes
- Coaching outcomes
Individual results vary significantly and depend upon numerous factors beyond Holora’s control.

3.5 User Responsibility

- Ethical obligations
Professionals shall not represent themselves as employees, agents, representatives, or spokespeople of Holora unless expressly authorized in writing.

are conducted solely between the participating parties.

Users may purchase:

through the Marketplace.
Holora acts solely as a platform provider and payment facilitator where applicable.
Holora is not the provider of the underlying service unless expressly stated otherwise.

Disputes arising between Users and Professionals shall be resolved directly between the parties.
Holora is not obligated to:

- Guarantee outcomes
Holora may, at its sole discretion, assist in reviewing complaints or taking platform enforcement actions.

Holora does not necessarily endorse or agree with such content.
3.11 User Acknowledgement of Risk
Users acknowledge that interactions with Professionals may involve risks including:

- Emotional distress
- Financial loss
- Dissatisfaction
- Miscommunication
- Scheduling disputes
- Service disputes
Users voluntarily assume all risks associated with engaging Marketplace services.
3.12 Independent Business Operations
Professionals operate independent businesses.
Professionals are solely responsible for:
- Taxes
- Regulatory obligations
- Professional insurance
- Employment obligations
- Legal compliance
- Accounting obligations
Holora assumes no responsibility for a Professional’s business operations.
3.13 Reviews and Ratings
Users may submit ratings and reviews.

of reviews submitted by Users.
Reviews represent personal opinions only.
Holora reserves the right to remove reviews that violate Platform policies.
3.14 Removal of Professionals
